Terms & Conditions
1. These terms supersede all previous business
agreements.

2. We do not accept liability for damage or injury
through misuse of products purchased.
|
3. Unless stated in writing these conditions override
any negotiations referred to by the purchaser.
|
4. Any damages or shortages - notify within 48 hours
of receipt of goods in writing by post or by e-mail. Please note some
items such as bulbs and batteries are sold as consumables and as such
where the notification period has passed
guarantees do not apply. KMNW provides a
limited warranty against manufacturers defects with regards to either
materials or workmanship on all its products. This warranty does not
apply
to normal wear and
tear or any damage caused by misuse, careless or unsafe handling,
alterations, accidents or repairs.
Other
branded manufacturers
own warranties also apply.

5. Deliveries must be checked by the customer before
signing a receipt from the courier. The company will not be held
responsible for goods damaged in transit if signed for, with no
reference to the condition it was delivered in on the couriers delivery
note. Please note for damaged item claims all original packaging must
also be returned.

6. KMNW
endeavours to hold all items in stock ready for immediate next day or
standard delivery. Please note delivery times are not guaranteed! In extreme
cases where
items are out of stock we will notify you of the expected delivery times. With reference to our polyurethane
training weapons these items are manufactured to order, customers should
allow up to 15 days for delivery. |
7. Designs and colour schemes may vary due to the manufacture and/or dye process of some items from time to time.
All photos, pictures and sizing used are for guidance only and colours displayed
may actually differ slightly from actual colours depending on display
colour setting and lighting conditions.

8. Refusal of goods at the time of delivery will
result in full postal charges being incurred by the customer - to
included sending back to source.
|
9. Debt collecting agency or court charges will be
passed to the customer.
|
10. Parcels not received/lost - normal channels pursued
before compensation allowed if any. Items can not be
classed as lost until 15 working days have expired. In extreme cases please allow up to 60 days for any
compensation claims to be completed. We do not accept liability for missing/lost items
where the customer as supplied incorrect delivery details.

11. Minimum p&p (standard post) paid on returns
(receiving and sending out) and where free postage is shown. If claimed
by the customer at time of sending packaging to be enclosed if parcel
damaged upon receipt.
|
12. Please remember to state why you are returning the
item, in writing, and enclose a copy of the relevant invoice. Please
also refer to our Returns Policy.
|
13. In the event of a customer booking a course the
following conditions apply when the customer wishes to cancel.
Cancellation notice received more than 3 days prior to
the course - Customer is allocated to next available course of their
choice.
Cancellation notice received less than 3 days before
the course, customer is allocated to the next available course provided
spaces are available for that course. Space will be confirmed 12 hours
prior to their preferred course.
No cash refunds. Only credit notes when applicable.

14. Goods are subject to availability. We reserve the
right to alter specifications and/or products without notification.
|
15. Third party cheques not accepted.
|
16. An admin charge (minimum 3%, maximum 50% of total
order value) will apply at the discretion of the company where necessary
e.g. account information,
insurance, tax, solicitor, returns, loss of profit, re-stocking in the event of a cancelled order (exception see clause 26 below) and recovery of costs etc etc (not inc.p&p).

17. £10.00 charge for uncleared cheques (per cheque) -
for any reason e.g. returned by bank or re-presented.
|
18. Ownership of goods will be passed to the purchaser
when payment is received in full.
|
19. Prices are subject to alteration without prior
notice.
|
20. No custom order, specific order, sale or
discounted/discontinued item will
be accepted for refunds or exchanges.
|
21. Back ordered goods will be dispatched a.s.a.p and
will not incur extra postal charges.
|
22. All currency exchanges and
purchases via the online shop are processed in GBP (Great British
Pounds/Sterling)
|
23. VAT (TAX) For orders made
from the UK or the European Union, 17.5% VAT is automatically added to all
orders and invoices. For those customers who supply a
validated Euro VAT number
and for
all other countries outside of the EU, 17.5% will be deducted from all orders/invoice.

Please note: A £2.50 (minimum)
administration charge will apply to any customers who supply a
incorrect Euro VAT number which results in any order having to be
cancelled/voided or refunded.

24. Customs
and duty. Please note that all shipments to
US and Rest of World destinations may be subject to import duties and
taxes, which are levied once a shipment reaches your country. Additional
charges for customs clearance must be borne by you; we have no control
over these charges and cannot predict what they may be.

25. Deliveries made to PO Boxes, Public buildings,
Multiple occupancy buildings and
such like are the sole
responsibility of the customer. We do not accept any liability for loss,
damage, items signed for by another or returned items once they have been despatched. We
remind customers that items are delivered to a specific address not to a
specific person.

26. Under the terms of the Distance Selling Regulations
(exception-see clause 20 above) purchasers of KMNW merchandise have the right to cancel their order within
7 days of delivery. To cancel your order email
us here. If goods have already
been dispatched then they can be returned unopened in original packaging.
Return address will be supplied upon email request. Postage costs are
non-refundable.
The regulations require the consumer to send a notice of
cancellation in writing including fax or email. A telephone call is not
enough. In the event of cancellation the goods must be returned as new
(and for the videos and DVDs unused & unopened) at the consumer's own
expense. If the goods are not returned KMNW can arrange for the goods to
be collected and direct cost will be returned from the refund total

27. Customers wishing to contact us must do so directly

(http://www.kmnw.co.uk/services.htm). Contact made through 3rd parties or
personalised e-mail address etc can not be guaranteed.

28. Web Links. We may from time to time provide
links to websites owned and operated by third parties. While every effort
is made to review these links and contents of said websites we have no
control over that content or security of those third party websites. If
you decide to access a third party website through a link on the Website,
you do so at your own risk. We make no representations regarding the
content of third party websites or any results that may be obtained from
using them.

29. English laws apply to KMNW
|
30. We may amend these terms and conditions at any time
without prior notice. If we do amend these terms and conditions, the
amended terms will be effective when posted on this website.

31. For customers choosing Credit/Debit cards as their
payment method a minimum order value of £6.00 is required. For orders
under this amount we reserve the right to cancel with notification. For
customers choosing the PayPal method of payment there is a 2.8% surcharge.
